Maternity Benefit Act, 1961

The Maternity Benefits Act provides for two nursing breaks for every nursing mother until her child is 15 months old. This is in addition to the normal lunch break and other breaks that all workers get. Every woman should defend her right to nursing breaks and see that employers follow the law protecting breastfeeding mothers and children.

Issues in Implementing Maternity Benefit Act

Maternity protection is an essential pre-requisite for women’s rights to gender equality with regard to their work and profession. The right to maternity protection is enshrined in the International Human Rights Instruments, International Labour Conventions, in the Constitution of India and implemented thought the Maternity Benefits Act, 1961.
